In this data protection statement, we tell you about the personal data processed by Fargo Vintage & Design, the methods of processing personal data and how you can exercise your rights related to personal data.

In this privacy statement, the word "Online Store" refers to the Fargo Vintage & Design online store and the websites where the online store is available.

"User" or "you" refer to users of the Online Store, who are representatives of our user organizations selling products and services in the Online Store, as well as buyers who order services or products through the Online Store in their own name or as representatives of our user organizations acting as buyers. The organization on behalf of which the User uses the Online Store is referred to by the term "User Organization".

We may update this privacy statement from time to time, if it is necessary due to changes in data processing or for some other reason. The up-to-date version is in the Online Store. We will not make significant changes to this privacy statement without notifying you of such changes.

  1. PROCESSED PERSONAL DATA AND INFORMATION SOURCES

We collect and process two types of personal data: User data and Analytics data.

User information

We collect User Data from our Users in different ways, for example when Users register in the Online Store, subscribe to our newsletter or fill out a form in the Online Store. Please note that we also collect information regarding product purchases and sales that you make through the Online Store.

User information that is necessary to use the Online Store

The collection of the following User Information is necessary for you to use the Online Store:

  • full name
  • email address
  • password

If you use the Online Store as a buyer, using the Online Store also requires the collection of the following information:

  • payment instrument information, such as your payment instrument number and expiration date (information is required to place orders through the Online Store, but Fargo Vintage & Design does not store the information, as Fargo Vintage & Design uses an external payment service provider to process payments)
  • An identifier that connects your payment card to the selected payment service

Optional user data

We can also process the following user data that you voluntarily provide:

  • delivery address
  • other information that you give us when creating your user account or later when changing account information
  • marketing consents and prohibitions
  • information you provide to us by phone or email

Analytics data

Although we do not normally use Analytics Data to identify individuals, you may sometimes be identifiable from it either directly or indirectly when combined with User Data. In these cases, Analytics data is considered personal data in the sense of the applicable legislation and we process it as personal data.

We automatically collect the following Analytics data when you use the Online Store:

Device information. We collect the following information about the technical devices you use when using the Online Store:

Usage information. We collect information about your use of the Online Store, such as:

  • the time you have spent in the Online Store
  • usage information from the online store
  • information about the orders you placed through the Online Store

We use different technologies to collect and store Analytics data when the User visits the Online Store. These technologies include, for example, cookies.

A cookie is a small text file that is sent to the User's computer and stored there, which enables the website administrator to identify visitors who visit the site frequently, to facilitate the use of the Online Store by visitors, and to enable the compilation of composite information about visitors. With the help of this feedback, we are able to constantly improve our services and better serve our Users. Cookies do not damage users' computers or files. We use them in such a way that we can offer Users information and services according to the individual needs of each.

  1. PURPOSES AND LEGAL BASIS OF PERSONAL DATA PROCESSING

Purposes

Fargo Vintage & Design processes personal data for the following purposes:

To offer the Online Store and to fulfill our obligations based on contractual relationships

Fargo Vintage & Design processes your personal data in order to provide you with the Online Shop in accordance with the agreement between you and Fargo Vintage & Design or the User Organization and Fargo Vintage & Design.

We use the information where applicable, for example to process payment transactions and to provide the User Organizations using Verkkokauppa in the role of a seller with the necessary information to deliver your orders. If you contact us, we use the information provided to answer questions and solve possible problems.

To comply with our legal obligations

Fargo Vintage & Design may process personal data to administer and fulfill its legal obligations. This includes, for example, processing data to comply with accounting obligations and providing data to appropriate authorities, such as tax authorities.

For handling claims and legal proceedings

Fargo Vintage & Design may process personal data in connection with legal claims, collection and legal proceedings. We may also process information to prevent fraud and misuse of our services, as well as for data, system and network security.

For customer communication and marketing

Fargo Vintage & Design may process your personal data in order to contact you in matters related to the Online Store and to notify you of changes to the Online Store. We can also use your personal data to market the Online Store to you. You can revoke your direct marketing consent at any time.

To improve quality and analyze usage trends

We can process your information regarding the use of the Online Store in order to improve the quality of the Online Store, for example by analyzing various trends related to the use of the Online Store. We may also use personal data for customer satisfaction surveys to ensure that Verkkokauppa meets your wishes. Whenever possible, we only use aggregated data from which no individuals can be identified for this purpose.

Legal grounds for processing

Fargo Vintage & Design processes your personal data to fulfill its contractual obligations to you and to fulfill its legal obligations.

In addition, we process personal data on the basis of our legitimate interest when fulfilling our obligations according to the agreement between us and the User Organization, as well as to conduct, maintain and develop our business and to create and maintain customer relationships. When we process your personal data based on our legitimate interest, we balance our legitimate interests with your right to privacy and, for example, provide you with easy ways to opt out of our marketing communications and use pseudonymized data or aggregated data from which you cannot be identified whenever possible.

In some parts of the Online Store, your consent to the processing of personal data may be requested. In these cases, you can withdraw your consent at any time.

  1. TRANSFER TO COUNTRIES OUTSIDE EUROPE

Fargo Vintage & Design stores your personal data primarily in the European Economic Area. However, the service providers we use operate in several geographical areas. We and our service providers can transfer personal data to countries, or gain access to them in countries outside the European Economic Area or your country of residence.

We take measures to ensure that the level of protection of your personal data is sufficient where your personal data is processed. We arrange adequate protection for the transfer of personal data to countries outside the European Economic Area with the contracts we have concluded with our online retailers based on model contract clauses approved by the European Commission or with other similar arrangements, such as the Privacy Shield arrangement

  1. RECIPIENTS OF PERSONAL INFORMATION

We share your personal information only within the Fargo Vintage & Design organization and only to the extent reasonably necessary for the purposes described in this privacy statement.

We do not share personal information with third parties outside the Fargo Vintage & Design organization unless one of the following circumstances exists:

Sharing is necessary for the purposes of this privacy statement, as well as sharing with authorized service providers

In addition, we may hand over personal data for processing to authorized service providers providing services to us (including our subcontractors providing data storage, accounting, sales and marketing services) and to service providers providing payment services for the processing of your payments.

When third parties process data on behalf of Fargo Vintage & Designing, Fargo Vintage & Design has taken appropriate contractual and organizational measures to ensure that personal data is processed solely for the purposes stated in this privacy statement and in accordance with applicable laws, regulations and our instructions, in compliance with appropriate confidentiality obligations and security measures.

Please remember that when you hand over your personal data directly to a third party, for example through a link in the Online Store, the processing of personal data is usually based on the third party's own privacy statements and processing principles.

For legal reasons

We may disclose personal information to third parties outside the Fargo Vintage & Designing organization if we reasonably believe that access to and use of the personal information is reasonably necessary to (i) comply with any applicable law, regulation, and/or court order; (ii) to detect, prevent and deal with fraud, crime or information security issues or technical problems; and/or (iii) to protect the interests or property of Fargo Vintage & Design or the Users, or to ensure safety or to protect the public interest in accordance with the law. Where possible, we will notify you of such transfer and processing.

For other legitimate reasons

If Fargo Vintage & Design is a party to a merger, business transaction, or other business transaction, we may disclose personal information to a third party involved in that transaction. In this case, however, we ensure that all personal data remains confidential. In this case, we will inform about the transfer as soon as is reasonably possible to the Users whose personal data is affected by the transfer or whose personal data is processed by a different privacy statement.

With express consent

We may disclose personal information to third parties outside the Fargo Vintage & Design organization for reasons other than those mentioned above when we have your express consent. You have the right to withdraw your consent at any time free of charge by contacting us.

  1. STORAGE PERIOD

Fargo Vintage & Design does not store personal data longer than the maximum time allowed by law and only as long as it is necessary to provide the Online Store or part of it. The retention period depends on the nature of the data and the purpose of the processing. The maximum storage period may therefore vary on a case-by-case basis.

We delete certain User Data related to your user account after you delete your user account. However, we retain some necessary personal data, such as contact and payment data and communication data as long as the law requires us to do so or we have a legitimate reason to retain the data, for example due to the processing of claims, accounting obligations, internal reporting, dispute resolution or other legal action.

We also store Users' email addresses for direct marketing purposes for the time being. If the User later prohibits the sending of electronic direct marketing, we will delete other information related to the electronic direct marketing order, but we will retain the information that the User has refused electronic direct marketing so that we can make sure that the prohibition is followed.

  1. YOUR RIGHT

The right to access information

You have the right to access the personal data we process about you. You can see certain information about you through your Verkkokaupa user account or by asking us for a copy of the personal information we have collected about you.

The right to withdraw consent

If the processing is based on the User's consent, the User can withdraw the consent at any time free of charge. Withdrawing consent may limit the User's ability to use the Online Store. Withdrawal of consent does not affect the legality of the processing of personal data processed before the withdrawal.

The right to demand correction of information

You have the right to demand that we correct or complete incorrect or outdated personal data we have stored by contacting us.

The right to demand deletion of information

You can ask us to remove your personal data from our systems. We will carry out the measures according to the request, if we do not have a legitimate reason not to delete the information.

The right to resist

You can object to the processing of your personal data if the data is processed for purposes other than providing the Online Store or fulfilling a legal obligation. Objecting may, however, limit your opportunities to use the Online Store.

The right to limit the processing of information

You can ask us to limit the processing of your personal data, for example, when your deletion, correction or objection requests are being processed and/or when we have no legitimate grounds to process your data. However, this may limit your opportunities to use the Online Store.

The right to transfer data from one system to another

You have the right to receive your personal data from us in a structured and commonly used format, and the right to independently transfer the data to a third party.

Exercising rights

The above-mentioned rights can be exercised by sending a letter or e-mail to the above addresses, which contains the following information: User's full name, company name, address, e-mail address and telephone number. We may request the delivery of additional information necessary for proving the User's identity. We may reject or charge a reasonable processing fee for requests that are unreasonably frequent, excessive, or clearly unfounded.

  1. DIRECT MARKETING

The User has the right to prohibit us from using the User's personal data for direct marketing, market research and profiling for direct marketing purposes by contacting us in accordance with the contact information indicated above or by using the option to cancel the order offered in connection with direct marketing messages.

  1. MAKING A COMPLAINT

If the User considers that our personal data processing activities are in violation of the applicable data protection legislation, he can file a complaint with the local supervisory authority. The local supervisory authority in Finland is the Data Protection Commissioner (tietosuoja.fi).

Alternatively, the User can file a complaint with the local supervisory authority of their place of residence.

  1. INFORMATION SECURITY

We use administrative, organizational, technical and physical security measures to protect the personal data we collect and process. The measures we use include, for example, data encryption, pseudonymization, firewalls, secure spaces and systems protected by limited access rights. Our security measures are designed to maintain an appropriate level to ensure data confidentiality, integrity, availability, fault tolerance and recoverability. We regularly test the Online Store, our systems and other hardware for vulnerabilities.

If, despite data security measures, a data security breach occurs that is likely to have harmful effects on the Users' privacy, we will notify the relevant Users and other affected parties of the breach as required by the applicable legislation, and, if required by the applicable data protection legislation, to the authorities as soon as possible.
